| Terms and Conditions |
1. These Terms and Conditions apply to all gift vouchers (“Voucher” or “Vouchers”) and experience events (“Experience” or “Experiences”) placed by, or on behalf of, our clients. These Terms and Conditions replace any of our earlier terms and conditions in relation to our Vouchers or Experiences and no variation to these Terms and Conditions shall be binding unless agreed by the Company in writing. By purchasing a Voucher or booking an Experience with the Company, you agree on behalf of yourself and if not yourself, the person for whom the Experience is intended to be bound by these Terms and Conditions in their entirety. 2. You must contact us within 6 months of purchasing the Voucher, quoting the Voucher number, to make an initial booking for your flight. If you do not do so the Voucher will be invalid and you will lose the right to that flight. We will not make any refund under these circumstances. 3. Vouchers are only valid for twelve (12) months from the date of purchase. Any Experience purchased must be booked to take place within such period of validity. We will not be liable for the non-delivery of any Vouchers which you request to be dispatched by any regular post, special delivery, courier or other delivery service we may offer nor for any losses arising from such non-delivery. The gift voucher is invalid if it has been tampered with or defaced. The Company accepts no responsibility for lost or stolen gift vouchers. Please keep the vouchers in a safe place and protect them as you would money. Duplicate Vouchers are available and are subject to a £10 administration fee. Expiry extensions may be available on payment of a fee. 4. It is your responsibility to ensure that you purchase a Voucher appropriate for the intended recipient and it is the responsibility of the recipient to double check that the restrictions are not prohibitive. The Company is not responsible for any unsuitable vouchers being purchased and Vouchers are strictly non refundable. It is the purchaser’s responsibility to pass the Voucher, along with these Terms and Conditions to the recipient. 5. Vouchers can be exchanged subject to written confirmation by letter within 6 months of purchase subject to a £20 administration charge. If the substituted Experience costs more than the original gift voucher you must pay the difference, including the administration charge. If the exchanged Voucher is lower in price, less the administration charge, no refund is payable. 6. Discount codes are issued subject to availability and can be withdrawn without notice at any time. The Company reserves the right to stop discount codes being used against specific products. Only one discount code can be used per order. Discount codes apply to internet orders only. 7. Once you have reserved your Experience, and if you have not already done so, you must send the Company your Voucher in order to confirm your booking. You will then be sent a confirmation letter by the Company. You must present this confirmation letter on the day of the Experience. Failure to present your letter may mean you forfeit your Experience. Please do not arrive at a venue expecting to redeem your gift voucher without first obtaining a booking confirmation letter or number from the operator. The Company will not be held liable for your costs incurred if you do not follow the procedure set out in these Terms and Conditions and in your voucher pack. The majority of our flights are flown during the week although we may have limited availability at weekends. We cannot guarantee weekend availability. 8. Once an Experience has been confirmed any amendments to the date or time may only be made up to 10 working days before the booked date and will be subject to an administration fee of £50. No amendments can be made to a booking within the period of 10 days before the booked date. We reserve the right to postpone an experience previously booked and to offer an alternative booking. 9. Experiences are completely dependent on the weather and are regulated by the Civil Aviation Authority (CAA) under the Air Navigation Order. Due to the nature of these activities, they may be subject to cancellation or delay due to localised weather conditions or other operational factors beyond our control. The Company, its servants or agents accept no responsibility for bad weather, mechanical problems or unforeseen events causing the contracted Experience to be cancelled or altered from that contracted for. The Company cannot be held liable for any costs incurred in this circumstance. It is the responsibility of the flyer to check the flying status telephone line frequently throughout the flying day as updates are posted regularly. The flying status telephone number is included on the confirmation letter. 10. If the Experience is cancelled for whatever reason, it is your responsibility to re-book your Experience with the Company within fourteen (14) days of the cancelled Experience. If you fail to do this we reserve the right to void the Experience. 11. In the event that insufficient places have been booked ten (10) days prior to a flying day, the Company may cancel Experiences for that date and offer alternative dates and/or venues. The Company maintains the right to cancel alter or reschedule your flying activity without incurring any penalty. The Company reserves the right to make reasonable changes to the programme of any activity, provided these changes do not affect to any material extent the nature and scope of the activity. Should the Company be obliged to cancel, the flyer can be rebooked to another day at no extra cost within the validity of voucher. 12. If you fail to arrive by your scheduled reporting time on the day of your pre-booked flying day then you forfeit your Experience. All Experience flight times are “chocks-off” to “chocks-on”. 13. If we have to postpone your Experience on 3 or more occasions for normal operational reasons and your Experience is valid for a period of less than 2 months, we will extend the validity of your Voucher to include the next 2 months of the main flying season, which is normally April to September. If this extends the validity of the Voucher into the flying season of the next year, the Voucher will also be valid for the intervening months although booking restrictions do apply. The provision of an extension does not affect your statutory rights and the standard terms and conditions apply. 14. If your Experience is not taken within that time you will lose the right to participate in the Experience unless you have booked on at least 3 occasions which have had to be postponed for normal operational reasons, or the validity period of the Voucher has been extended for some other reason under these Terms and Conditions. If your Experience has been postponed more than 12 months for normal operational reasons you will be asked to pay the difference between the price paid for the product and current price of the same product. In any event, the Voucher or Experience will not be valid after 24 months from the date of purchase. 15. The Company may use a third party experience operator (“Third Party”) to fulfil an Experience. Although the Company has sought to select highly experienced operators, the Company shall not be responsible for the safety standards or the quality or delivery of the experience, or any loss or damage suffered by you whilst participating in the experience for which the Third Party shall be solely responsible. We do not undertake any technical examination of equipment, facilities or services in order to minimise personal risk. Once your Experience has booked by a Third Party you are bound by their terms and conditions. It is the Flyer’s responsibility to make themselves aware of these at the time of booking. 16. The total liability of the Company for any claim whatsoever in connection with the Voucher or Experience shall be limited to the price paid. The Company has tried to ensure that the descriptions and images used on all marketing material are accurate. However, images are intended to give a general idea of the experience described and do not form any contract between the purchaser and / or recipient and the Company. 17. The Experience intrinsically involves the possibility of physical risks greater than those encountered in daily life, even though they are conducted under the supervision of qualified pilots who exercise all due precautions to ensure safety. By taking part in such flying activities passengers are understood to be fully aware of these risks. We are not qualified to express an opinion confirming that you are fit to fly and you must ensure that you are fit to fly. 18. You must not fly if you are suffering from any serious medical condition (including epilepsy, fits, severe head injury, high blood pressure or heart conditions), or have recently undergone surgery, unless you have a certificate of your fitness to fly from your doctor. You must not fly if you are pregnant or under the influence of alcohol or drugs. The Flyer is responsible for advising the Company of any disabilities or problems of health that might affect personal safety. 19. You agree on behalf of yourself and the Flyer to observe and comply with any advice, instruction, request or decision made by us whether on the grounds of the safety of the Flyer or any other person or for any other reason at all. You agree on behalf of yourself and the Flyer that our opinion on all matters regarding safety will be final. You agree on behalf of yourself and the Flyer that any Flyer acting in a manner which in our opinion is dangerous, or may interfere with or disrupt the Experience will at our sole discretion and without further liability to us immediately have their Experience terminated without refund. The Flyer must not have consumed any alcohol prior to the Experience and we will be entitled at the time for any Experience to prevent a Flyer from flying who in our opinion may have consumed alcohol beforehand. No Flyer will be allowed to take part in any Experience unless they have attended the full safety briefing preceding the Experience. Some personal insurance policies may not cover some of our Experiences. 20. DUE TO THE NATURE OF THESE ACTIVITIES, ALL VOUCHERS ARE STRICTLY NON REFUNDABLE UNLESS RETURNED WITHIN 7 DAYS OF PURCHASE. ANY VOUCHERS RETURNED WITHIN 7 DAYS WILL BE SUBJECT TO A £25 ADMINISTRATION FEE. All requests for refunds must be made in writing by the original purchaser. Refunds will always be made to the person who paid for the Voucher, and if originally purchased by credit card, the refund will be credited to the same card. Vouchers can be transferred to another name, or the validity date extended on the payment of an administration fee. 21. By purchasing a Voucher or Experience you authorise the Company to store the information provided in relation to the purchase of vouchers which will be kept in both manual and electronic storage systems and to exchange this information as passenger booking circumstances require. 22. The purchaser or the person(s) for whom the Experience is intended needs to be aware that the provision of the service is both seasonal and entirely weather dependant and may occur more than 30 days after the transaction.
